《泰安市城市供水管理办法》已经市政府批准,现予公布,自2007年11月1日起施行。

泰安市城市供水管理办法
第一章 总 则
第一条 为加强城市供水管理,保障城市生活、生产用水和其他用水,根据国务院《城市供水条例》等有关法律法规规定,结合我市实际,制定本办法。
第二条 从事城市供水和使用城市供水的单位和个人,必须遵守本办法。
第三条 市建设行政主管部门负责全市城市供水行业的管理工作。
发展改革、规划、水利、环保、卫生、物价等部门应按照各自职责,做好城市供水管理的相关工作。
第四条 城市供水应坚持开发水源与计划用水、节约用水相结合,确保供水安全,优先保障城市居民生活用水,统筹兼顾工业用水和其他用水。严格控制开采地下水,鼓励中水回用。
第五条 城市供水事业应纳入国民经济和社会发展计划,保障城市供水能力与经济建设和社会发展相适应。
第二章 供水规划和建设
第六条 市、县(市)人民政府应当组织规划、水利、建设等行政主管部门共同编制城市供水规划,并纳入城市总体规划。
第七条 市、县(市)环保部门应会同规划、水利、建设、卫生等部门共同划定饮用水水源保护区,经批准后公布。在饮用水水源保护区内,禁止一切污染水源的活动。
第八条 新建、改建、扩建城市供水工程,应符合城市供水规划,经水资源论证后,按城市建设项目审批程序报有关部门审批。
第九条 城市供水工程的设计、施工和监理,应委托持有相应资质证书的单位承担,并遵守国家有关技术标准、设计规范和监理规范。
禁止无资质或超越资质证书规定的范围承担城市供水工程的设计、施工和监理业务。
第十条 城市供水工程竣工后,建设行政主管部门应会同有关部门按规定进行验收。未经验收或者验收不合格的,不得投入使用。
第三章 供水经营和用水管理
第十一条 从事城市公共供水的企业和自建设施供水的企业(以下简称城市供水企业),必须经建设行政主管部门进行资质审查合格、经工商行政管理部门登记注册后,方可从事供水经营活动。
第十二条 城市供水企业应保持不间断供水。
因工程施工、设备维修等原因确需停止供水或者降压供水的,城市供水企业应提前24小时告知用户和公安消防机构。凡不能间断用水的用户,应自建贮水设施。
因发生自然灾害或紧急事故造成停止供水时,城市供水企业应立即组织抢修,尽快恢复供水,同时通知用户和公安消防机构,并报告建设行政主管部门。
抢修供水设施时,对妨碍抢修的情形,城市供水企业可以采取必要的措施排除妨碍;造成损坏的,应给予修复或赔偿。
第十三条 城市供水水质必须符合国家规定的标准。
城市供水企业应建立健全水质检测机构和检测制度,按照国家规定的检测项目、检测频率和有关标准、方法,定期检测水源水、出厂水和管网水的水质,做好各项检测分析资料和水质报表存档、上报工作。
第十四条 城市供水企业应实行职工持证上岗制度。直接从事供、管水工作的人员,必须取得健康合格证后方可上岗。
第十五条 城市供水企业应按照国家有关规定设置管网测压点,做好水压检测工作,确保城市供水管网压力符合国家规定的标准。用水水压需要超过国家规定管网末端压力的,应自建贮水加压设备。
第十六条 城市供水企业应定期向有关部门报送供水水质、用水总量及用水户用水量等有关资料。
第十七条 城市公共供水管网新增加的用水户,应当由建设行政主管部门核定用水指标后,持书面申请到城市供水企业办理用水手续。其中,建设工程施工临时用水,由建设单位办理用水手续。
第十八条 城市供水企业应与用水户签订供用水合同,明确双方的权利和义务。
用户过户、停止用水、恢复用水、变更用水性质等,应向城市供水企业提出申请并结清原用水水费后,方可办理相关手续。
用户不得擅自变更用水性质。
第十九条 对城市居民供水实行一户一表、计量出户、抄表到户、收费到户制度。
新建或改建居民住宅,应按照一户一表、计量出户的要求进行设计、施工。对已建成的居民住宅,应进行水表户外设置改造。
第二十条 用水单位和个人应按照用水量和水价标准按时缴纳水费。无正当理由不按规定或合同约定缴纳水费的,城市供水企业可按约定暂停供水;用户在结清水费、缴纳违约金后,城市供水企业应立即恢复供水。
采取停止供水措施时,城市供水企业应提前两日通知用户。
第二十一条 城市供水企业应按月抄表计量。对不能正常抄表计量的情形,应采取措施及时恢复正常抄表计量。因用户原因造成不能查抄水表的,在恢复正常抄表前,按前三个月中最高用水月的用水量计收水费;非用户原因的,按前三个月平均用水量计收水费。
第二十二条 禁止盗用或转供城市公共供水。对盗用和擅自转供城市公共供水的,由城市供水企业按取水管径最大流量计收水费。
第四章 供水设施维护
第二十三条 城市供水企业对其管理的供水管网和供水设施,应定期检查维修,确保安全运行。
第二十四条 城市供水设施由产权人负责管理、维修或改造。
(一)城市用水单位与供水企业的产权界定。供水设施产权以城市供水企业设计安装的计量总水表处为界,水源侧的管道和附属设施至计量总水表处(含总水表)产权归城市供水企业所有;计量总水表以下管道及设施产权归用户所有。
(二)城市居民用水户与城市供水企业的产权界定。城市居民供水实行一户一表、计量出户的,供水设施产权以计量水表处为界,水源侧的管道和附属设施至计量水表处(含水表)产权归城市供水企业所有,计量水表以下管道及设施产权归用户所有。尚未进行水表户外改造的,按原约定执行。
居民住宅区内供水管道和供水设施产权尚未明确的,由建设行政主管部门按以上产权界定原则,组织产权界定和产权移交。
第二十五条 在规定的城市供水设施安全保护范围内,禁止任何单位和个人擅自挖坑取土或者修建建筑物、构筑物以及其他危害城市供水设施安全的行为。
第二十六条 任何单位和个人不得擅自改装、拆除、迁移城市供水设施,因工程建设确需改装、拆除或者迁移的,应报建设行政主管部门和城市规划行政主管部门批准,与城市供水企业商定改装、拆除或者迁移方案,同时采取相应补救措施后方可实施。
第二十七条 涉及城市供水设施的建设工程开工前,建设单位或施工单位应向城市供水企业查明地下供水管网情况。施工中影响到城市供水设施安全的,建设单位或施工单位应在开工前与城市供水企业商定相应的保护措施。
第二十八条 禁止擅自将自建供水设施、管网系统与城市公共供水管网连接。
因特殊情况确需连接的,必须经城市供水企业同意,报建设行政主管部门和卫生主管部门批准,并在管道连接处采取必要的防护措施。严禁产生或者使用有毒有害物质的单位将其生产用水管网系统与城市公共供水管网系统直接连接。
第二十九条 计量水表应符合国家规定的技术标准并经法定检测机构进行测定。未经测定或者测定不合格的,不得安装。
第三十条 城市二次供水设施,由产权单位负责二次供水设施的运行管理。二次供水设施产权单位应建立水质管理制度,配备专(兼)职人员,定期进行常规检测并对各类储水设施进行清洗消毒。不能进行水质常规检测的,应按规定委托法定检定机构进行定期检测。
第三十一条 禁止下列破坏城市供水设施或者危害城市供水安全的行为:
(一)擅自启闭供水阀门;
(二)擅自移动、拆卸、损坏计量水表;
(三)损毁供水井盖、阀门、管道等;
(四)在城市供水管网上直接装泵抽水;
(五)向城市供水设施排放污水、倾倒垃圾或向输水暗渠检查井内排放杂物;
(六)擅自从公共消防栓取水用水;
(七)其他损害城市供水设施或者危害供水设施安全的行为。
第五章 监督管理
第三十二条 建设行政主管部门应会同水利、环保、卫生等部门加强对城市供水的监督管理,建立城市供水突发事件应急预案、新闻发布等制度,保障城市供水安全和公众对城市供水的知情权。
第三十三条 违反本办法的行为,由建设行政主管部门或者其委托的单位依照国务院《城市供水条例》规定实施处罚。
第三十四条 建设工程施工危害城市供水设施的,由建设行政主管部门责令停止危害行为;造成损失的,由责任方依法赔偿损失。
第三十五条 建设行政主管部门的工作人员和城市供水企业的管理人员玩忽职守、滥用职权、徇私舞弊的,由其所在单位或者上一级机关给予行政处分;构成犯罪的,移交司法机关依法追究刑事责任。
第六章 附 则
第三十六条 各县(市)人民政府可参照本办法制定实施细则。
第三十七条 本办法自2007年11月1日起施行。1997年 1月9 日市政府发布的第44号令《泰安市城市供水管理办法》同时停止执行。

PART III THE REGISTER

The Registrar shall keep a register of ships

The register shall contain such particulars in respect of
ships,

charterers,
gagees and representative persons as are prescribed.
The register may be kept in legible or non-legible form but if
kept in
legible form any entry in the register shall be capable of
being

The High Court may, in proceedings under this section-

For the purposes of this section-
there is a material error in the register if there is an error
of fact

without limiting the generality of paragraph (a), there is a

an entry is made in the register without sufficient cause;

there is an error or defect in an entry in the register; and
the reference in paragraph (b) (i) to an entry omitted

ster shall be read as including a reference to a matter

ired or permitted by this Ordinance to be entered, or to remain,

register but is not entered in, or is removed from, the register.
The jurisdiction of the High Court under this section may be

Registrar may correct, or cause to be corrected, any clerical

PART IV REGISTRATION OF SHIPS
